01Scope and definitions

1.1 Recorded performance. Anything Sense/Net records, or commissions another to record, on any Fullfield track, and anything that appears in a title Sense/Net publishes.

1.2 Performer. A person whose own experience a recorded performance is made from: the person wearing the headpiece.

1.3 Participant. Any other person who appears in a recorded performance, including released extras and crew in shot.

1.4 Reference material. This Standard applies to recorded performances. It does not apply to reference material: material held only to develop, train or calibrate the company’s production tools, which is not shown to viewers and does not appear in any title, and which is held under a licence whose licensor warrants that the material was collected lawfully and with the consents its own terms require.

1.5 Created person. A person who appears in a title and does not exist, created by Fullfield Ambient. A created person is not a participant, and is not a likeness of anyone.

02Before recording

2.1 Before a performer auditions, the company tells them in writing which tracks will be recorded, where the title will be distributed and whether it will have an adaptive edition.

2.2 Every performer takes part in a consent session with a producer before any recording. The session is recorded on video. The performer may bring a representative of their choosing, whose reasonable fee the company pays.

2.3 Each track is agreed separately. The Breath and Heart tracks record the performer’s body rather than their performance; they require a separate consent, and a performer who refuses them keeps the booking and the fee.

2.4 No person under 18 is recorded as a performer or participant in any Fullfield title.

2.5 The company does not record a performer who appears, to the producer or the capture technician, unable to understand or to give consent on the day, whatever was agreed before.

03During recording

3.1 A performer may stop a take at any time, without giving a reason, by raising a closed fist or by saying “stop”. The capture technician ends the recording at once.

3.2 No track is recorded that the performer has not agreed to, and no recording continues after a performer has stopped it.

3.3 Every person in shot has signed a release, or the scene is recorded on a closed set or cleared location and its background is created by Fullfield Ambient.

04Review and release

4.1 The performer is shown the final cut of every track they appear in before anyone outside the production. They may ask for changes, and may withdraw their consent at any point before release.

4.2 A title from which a performer has withdrawn before release is not released. The company pays the performer for the work done.

05After release

5.1 A performer may ask at any time for a released title to be withdrawn from public access. The company withdraws it within 30 days and pays any residuals already earned.

5.2 A withdrawn title is kept in the Library and is not lent, licensed or deposited. Any copy already deposited with an archive is restricted at the company’s request.

5.3 The company does not license a performer’s likeness, voice or body tracks for any use other than the title they agreed to, and does not use them to train its tools without a further consent.

06Bystanders and participants

6.1 No member of the public appears in a title without a signed release.

6.2 Before release, every created person in a title is checked against the register of released participants, and any created person who resembles someone in it is replaced.

6.3 A person who believes they appear in a title may tell the company, which will check the title against every release it holds and reply in writing.

07Records

7.1 Consent sessions and releases are kept in the Library for seven years after the title is withdrawn or the performer dies, whichever is later, and are shown only to the performer, their representative and the company’s legal team.

7.2 A performer may have a copy of their consent session and releases at any time, free of charge.

08Disputes

8.1 A performer who believes this Standard has been broken may raise it with performer relations, and if not satisfied, with the general counsel.

8.2 A dispute that cannot be settled goes to binding arbitration in Los Angeles under rules agreed between the company and performers’ representatives. The company pays the arbitrator.
